DA FROM THE LEGITIMATE DEFENSE OF HONOR TO THE FEMINICIDE CRIME: a feminist analysis of facing violence against women in Brazil
Abstract
O presente artigo tem como objetivo geral fazer uma análise feminista do enfrentamento à violência contra as mulheres no Brasil. Nesse sentido, propõe um resgate histórico da atuação dos movimentos feministas no debate e defesa dos direitos das mulheres brasileiras, principalmente no que diz respeito a coibição da violência doméstica. Para tanto, apresenta os caminhos trilhados pelas feministas desde a época em que era aceita a tese da legítima defesa da honra pelos tribunais até a tipificação do crime de feminicídio pelo Código Penal brasileiro. Para a sua realização foi adotada a metodologia da pesquisa bibliográfica, desenvolvendo estudo exploratório com base em material já elaborado. Traz como resultados que a atuação do movimento feminista, principalmente a partir do final da década de 1970, foi fundamental para trazer a discussão da violência contra as mulheres para o âmbito público e para a sua criminalização, tendo como êxito a previsão do crime de feminicídio.
